Terms of Service

Who you are contracting with

These terms are between you and Bomani Digital ("Bomani Digital", "we", "us"), the provider of the digital workshops, website, online dashboard and downloadable materials (together, the "Service"). Bomani Digital trades online as Bomani.Digital.

Acceptance of these terms

By creating an account, purchasing access to an online workshop, downloading our materials or otherwise continuing to use the Service, you agree to these terms. If you do not agree, do not use the Service. If you are using the Service on behalf of an organisation, you confirm you have authority to bind that organisation; if you are using it as an individual, you confirm you are of legal age to enter into a contract.

What you are buying

Bomani Digital sells digital learning products. Your purchase is a module-specific workshop delivered electronically through an online dashboard for the price shown at checkout. The scheduled Zoom implementation lab is an included feature of the workshop, not the primary product.

Each purchase includes:

  • a downloadable digital workbook, prompt templates, worksheets and exercises;
  • ongoing online access to the purchased module materials;
  • instant access to your online learning dashboard, containing the materials, preparation checklist and Zoom lab link;
  • one scheduled live online implementation lab over Zoom;
  • streaming access to the replay of your live lab.

Access is delivered electronically to the email address used at checkout, normally within minutes of payment. Saturday and Sunday sessions cover the same module and have separate capacity. A replay of each live lab is added to your dashboard as streaming access after the session. No income, revenue or business outcome is guaranteed, and third-party AI tools referenced in workshops are owned by their providers and may change at any time.

Payment, orders and subscriptions

Orders are placed through Shopify Checkout. Bomani Digital is the seller of record and provides all customer service for orders; Shopify Inc. acts as our payment processor. Payment, billing, currency, taxes and checkout mechanics are additionally governed by Shopify's terms of service. Prices are shown at checkout and may include applicable taxes. Our own refund and rescheduling commitments are set out in our Refund Policy.

Your account

Keep your login details confidential. You are responsible for all activity under your account, and you must provide accurate information and keep it up to date. Tell us promptly if you believe your account has been compromised.

Licence and acceptable use

We grant you a limited, non-exclusive, non-transferable right to access the Service and the materials for the session or plan you purchased, for your own personal or internal business use. Workshop links, recordings and resources may not be shared, resold or redistributed. You must not:

  • use the Service unlawfully, or for fraud, spam or abuse;
  • infringe anyone's intellectual property or other rights;
  • interfere with the security of the Service, including introducing malware, probing, scanning or scraping;
  • reverse engineer the Service or circumvent technical or capacity limits;
  • harass, threaten or disrupt other attendees during live sessions.

Intellectual property

Bomani Digital (and its licensors) retain all ownership of the Service and all intellectual property in it, including the workshop curriculum, slides, worksheets, recordings, book, software, documentation and branding. Nothing in these terms transfers ownership to you. Any content you submit remains yours; you grant us a limited licence to host and process it solely to provide the Service.

Service level

We work hard to keep the Service available, but we do not guarantee that it will be uninterrupted, timely, secure or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

Suspension and termination

We may suspend or terminate your access to the Service, in whole or in part, for material breach of these terms, non-payment or chargeback, suspected fraud or a security risk, or repeated or serious policy violations — including removing an attendee who harasses others during a live session. You may stop using the Service and ask us to close your account at any time. On termination, your access to dashboards, resources and meeting links ends; we will give you a reasonable window to export your data on request before it is deleted or anonymised in line with our Privacy Policy.

Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential losses, including lost profits, lost data or loss of goodwill. Our total aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.

Indemnity

You agree to indemnify us against claims arising from your unlawful use of the Service, your breach of these terms, or content you submit.

Changes

We may update these terms and the Service from time to time. If we need to reschedule a session, we will notify registered attendees by email and offer a transfer or refund as described in the refund policy. Continued use after changes means you accept the updated terms.

General

You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control. These terms are governed by the laws of the state of New York, United States, and the courts located there have exclusive jurisdiction, without limiting any mandatory consumer rights you have where you live.
